Home Terms & Conditions Terms and Conditions Auctionizer ("Platform") is a free auction service operated by Beyeler Software ("Operator", "we", "us", or "our"). By accessing or using the Platform, you agree to comply with and be bound by the following Terms and Conditions ("Terms"). Please read these Terms carefully before using the Platform. By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. You must meet the following requirements to be eligible to use the Platform: You must be at least 18 years old and have the legal capacity to enter into binding contracts under the laws of your jurisdiction to use the Platform. You must be the lawful owner of any items you list for sale or have the full legal right, authority, and capacity to sell them. You must also ensure that the sale of these items does not infringe on any third-party rights or violate any applicable laws or regulations. You must be a resident of one of the following countries: Australia Austria Canada Germany Ireland Liechtenstein New Zealand Switzerland United Kingdom (UK) United States of America (USA) By accessing the Platform from any of these countries, you represent and warrant that your use complies with all applicable local laws and regulations, including those related to online commerce, auctions, and consumer protection. The Platform allows users to list items for auction and participate in bidding for free. You agree not to: Use the Platform for any unlawful purpose or in violation of any local, national, or international laws. Upload, post, or transmit content that is fraudulent, misleading, defamatory, obscene, or otherwise objectionable. Interfere with the operation or security of the Platform. A binding contract is formed between the seller and the winning bidder when an auction listed on the Platform concludes. The Operator is not a party to the transaction and does not guarantee the quality, condition, or legality of any item listed. Users are responsible for verifying the authenticity and legality of items and for fulfilling their obligations in the transaction. Sellers are strictly prohibited from placing bids on their own auctions or coordinating with others to artificially inflate prices (shill bidding). The Platform is free to use. Any payment arrangements between buyers and sellers are made directly between the parties. The Operator is not responsible for payment processing. Unless otherwise stated, all trademarks, logos, software, and design elements of the Platform are the intellectual property of the Operator or its licensors and are protected under copyright and intellectual property laws. You retain ownership of any content you submit to the Platform, including auction descriptions, and images ("User Content"). By posting your User Content, you grant the Operator a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it on the Platform solely to operate and promote the auction services. You confirm that you have the necessary rights to upload and share any User Content and that doing so does not infringe the rights of any third party. The Operator does not guarantee continuous, uninterrupted, or secure access to the Platform. The Platform may be unavailable or interrupted due to maintenance, upgrades, system failures, or reasons beyond the Operator’s control. To the maximum extent permitted by applicable law, the Operator shall not be liable for any damages or losses resulting from the unavailability, interruption, suspension, or termination of the Platform, regardless of the cause. To the maximum extent permitted by applicable law, the Operator disclaims all liability for any direct or indirect damages, including but not limited to loss of profit, data, or goodwill, arising from the use of or inability to use the Platform. The Operator shall not be liable for any disputes, claims, or damages arising between users. The Operator does not guarantee the legality, quality, or accuracy of any listings, nor the conduct of any buyer or seller. You agree to indemnify and hold harmless the Operator from any claims, damages, liabilities, costs, or expenses arising from your violation of these Terms or your use of the Platform. Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. We reserve the right to suspend, restrict, or terminate your access to the Platform at any time, without prior notice, if we believe you have violated these Terms, applicable laws, or the rights of other users. We also reserve the right to remove or delete any auction listing that we believe, in our sole discretion, violates these Terms, is unlawful, misleading, harmful, offensive, or otherwise inappropriate, without prior notice and without liability. These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Thurgau, Switzerland. We reserve the right to update or modify these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
